1. Acceptance & Modification of Terms

By accessing, creating an account, or using DaFreeAi ("the Platform", "the Service"), operated in the Netherlands, you agree to be bound by these Terms & Privacy provisions. If you do not agree to these terms, you may not use the Service.

We reserve the right to modify or update these Terms to reflect service enhancements, regulatory requirements, or security adjustments. Continued access to the platform following notice of material revisions constitutes acceptance of the updated Terms.

2. GDPR / AVG Privacy & Data Controller Policy

DaFreeAi operates strictly under European Union data privacy standards (GDPR / AVG) as an independent data controller in the Netherlands. We adhere to data minimization principles and never monetize or sell personal data.

• Account Authentication: User ID, avatar, and username retrieved via secure OAuth providers to verify access.
• Generation History: Prompts, resolution choices, model selections, and asset references stored in your private workspace.
• Billing Details: Payment tokens and transaction logs managed securely via Stripe. We do not store raw credit card numbers.
• Right to Deletion: You have the right to request a complete export or permanent deletion of your account and records by emailing contact@dafreeai.site or via our official Discord.

3. Creative Ownership & Commercial Rights

You retain 100% intellectual property rights and full commercial ownership of all visual assets, images, and video media generated through your DaFreeAi account.

You are free to monetize, broadcast, publish, and distribute your generated content across commercial projects, client deliveries, advertising campaigns, and social channels, subject to upstream model provider acceptable use policies.

4. Subscriptions, Credits & Included Generations

DaFreeAi offers flexible subscription tiers and on-demand credit packages billed securely through Stripe. Subscriptions automatically renew at the beginning of each billing cycle unless cancelled.

• Included Generations Allowance: Premium subscription tiers include an allowance of 100 Included Generations per 30-day billing period on designated fast models at up to 1K resolution. Supported models currently include GPT Image 2 (Low/Standard), Nano Banana 2 Lite, Seedream 5.0 Lite, FLUX.2, Recraft Vector, and Wan 3.0.
• Model Lineup & Allocation Adjustments: DaFreeAi reserves the unrestricted right to rotate, modify, add, replace, or update the lineup of eligible models, supported settings, generation parameters, and cluster allocations at any time without prior notice based on upstream AI provider capacities, operational requirements, and platform health.

5. Hassle-Free Cancellation & Billing Protection

You may cancel your recurring subscription at any time with zero cancellation penalties directly through your account dashboard or the Stripe Customer Portal. After cancellation, you retain full access to all paid features until the conclusion of your active billing period.

6. Acceptable Use & Content Safety

Users must maintain lawful and responsible conduct. The following activities are strictly prohibited and result in immediate account termination:

• Generating non-consensual sexually explicit imagery or any exploitation involving minors (CSAM).
• Content inciting violent extremism, hate speech, terrorism, or severe harassment.
• Infringing upon third-party intellectual property, proprietary trademarks, or copyrighted media.
• Attempting automated denial-of-service, API spoofing, or infrastructure exploitation.

7. Minimum Age & Payment Authorization

You must be at least 13 years of age (or the legal age of digital consent in your country of residence) to register and use DaFreeAi.

Payment Authorization & Parental Consent: To purchase credits, activate subscriptions, or perform any financial transactions on DaFreeAi, you must be at least 18 years of age, or have obtained explicit permission and authorization from a parent or legal guardian. Any unauthorized transaction or fraudulent dispute will result in immediate termination of the account.

8. Service Reliability & Upstream Models

DaFreeAi interfaces with official enterprise APIs and high-performance computing clusters to synthesize media. While we target 99.9% uptime and rapid rendering speeds, service availability may occasionally fluctuate due to upstream model capacity or scheduled maintenance.

9. Limitation of Liability

To the maximum extent permitted by applicable Dutch and European Union consumer law, DaFreeAi and its operators shall not be liable for indirect, incidental, or consequential damages resulting from temporary service unavailability. Nothing in these Terms waives mandatory consumer rights under EU directive.

10. Governing Law & Jurisdiction

These Terms & Privacy provisions are governed by and construed in accordance with the laws of the Netherlands and applicable European Union regulations. Any legal proceedings shall be submitted to the competent courts of the Netherlands, without prejudice to consumer protection laws of your EU country of residence.
